GDPR - General Data Protection Regulation

In accordance with the EU Personal Data Protection Act 2016/679 (GDPR), I voluntarily agree and accept that the Baby English language agency represented by Hana Petrušková, Klegova 1039/42, Ostrava Jih, 700 30, IČO: 73821179 (hereinafter referred to as the "administrator") processes, collects and stores my personal data and also the personal data of the child of whom I am the legal representative.

I acknowledge and agree that the personal data provided (hereinafter referred to as "personal data") in the scope of:

identification data - student's name and surname, student's date of birth, legal guardian's name and surname,

contact details of residence address, telephone number, e-mail address,

photographs and videos taken during classes

other personal data: such as student's level of knowledge, payment data,

including all information from personal, telephone and electronic communication

will be processed and stored by the administrator for the following purposes:

organization of language courses, keeping records of the course of language courses,

tax and payment

issuing student evaluations

sending offers organized by the administrator

survey for the needs of planned activities

displaying photographs or audio and video recordings on the administrator's website or social networks for the purpose of presenting its activities

photographs, audio and video recordings including copies or originals of artistic works created by children during classes can be used as teaching materials.

Rights of the data subject: I acknowledge that I have the right to:

access to personal data;

to correct or supplement personal data;

to delete personal data;

to restrict processing;

to object to processing;

to information regarding the correction or deletion of personal data or the restriction of processing;

to be informed in the event of a breach of personal data security;

to withdraw consent by sending a message to the address babyenglish@seznam.cz

Duration of data processing: I grant this consent to the extent necessary to fulfill these activities and for the period necessary to achieve them or for the period directly specified by legal regulations that require archiving, such as the Accounting Act, or until my consent is revoked.

Personal data will never be provided by the administrator to third parties for marketing purposes. They may be transferred in connection with the performance of the contract and the fulfillment of related legal obligations to external lecturers, providers of legal, tax and accounting services and providers of IT services. Data will always be transferred to processors in accordance with the required standards of personal data protection according to GDPR.

The processing of personal data is carried out by the controller, to the maximum extent in electronic form on a server with limited access. The controller is also responsible for technical and organizational measures, in particular to protect against unauthorized access to data and its misuse.

Personal Data We Process

In connection with enrolling a child and providing our courses, we may process the following personal data:

the child’s full name and date of birth;
the parent’s or legal guardian’s full name;
home address;
telephone number and email address;
information about the child’s level of English and previous English language tuition;
information required for payment records and compliance with accounting and tax obligations;
information provided in communications concerning enrolment and tuition.

Purposes and Legal Bases for Processing

We process personal data for the following purposes:

processing applications and placing children in suitable groups;
organising and providing tuition;
communicating with parents and legal guardians;
maintaining records of course participants and payments;
complying with accounting, tax and other legal obligations;
protecting and exercising our legal rights;
sending existing customers information about our own similar services.

The legal bases for processing are the performance of a contract, compliance with the controller’s legal obligations, the controller’s legitimate interests and, where stated below, consent.

Our legitimate interests include maintaining necessary communication, protecting and exercising legal claims, and offering our own similar services to existing customers.

Information marked as required in the application form is necessary for processing the application and providing tuition. Without this information, we may be unable to enrol the child in a course.

Photographs and Video Recordings

We take and publish photographs and video recordings of a child only with the separate consent of the parent or legal guardian, given in the application form.

Consent is voluntary and may be withdrawn at any time by emailing babyenglish@seznam.cz. Refusing or withdrawing consent does not affect the child’s ability to attend a course.

Withdrawal of consent does not affect the lawfulness of any processing carried out before the consent was withdrawn.

Information about Our Courses

We may send current and former customers information about similar Baby English courses and services by email.

You can opt out at any time by using the unsubscribe link included in the email or by contacting us at babyenglish@seznam.cz.

We send marketing emails to people who have not previously used our services only with their consent.

How Long We Keep Personal Data

We retain personal data:

for the duration of the contractual relationship and subsequently for as long as necessary to protect and exercise legal claims;
for the periods required by accounting, tax and other applicable legislation;
where processing is based on consent, until the consent is withdrawn or for the period stated when the consent was given;
for the purpose of offering our own similar services until the recipient opts out.

Once the relevant retention period has expired, we delete or anonymise the personal data unless further retention is required by law.

Recipients of Personal Data

Where necessary, personal data may be shared with:

teachers involved in providing tuition;
providers of accounting, tax or legal services;
providers of email, website, cloud and other technical services;
providers of services used for online tuition;
social media platforms where consent has been given to publish photographs or video recordings;
public authorities where disclosure is required by law.

We do not provide personal data to other parties for their own marketing purposes.

When certain online services are used, personal data may also be processed outside the European Economic Area. Any such transfer takes place only in accordance with the GDPR, particularly on the basis of an adequacy decision or standard contractual clauses.

We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse or disclosure.

Your Rights

In connection with the processing of personal data, you have the right to:

request access to your personal data;
request the correction or completion of inaccurate or incomplete personal data;
request the erasure of personal data where the legal requirements are met;
request restriction of processing;
object to processing based on legitimate interests;
receive your personal data in a structured and machine-readable format where the requirements for data portability are met;
withdraw your consent at any time;
lodge a complaint with the Office for Personal Data Protection.
